In many cases, the lender agrees to accept less than the total amount due and will release or satisfy the mortgage and the note. The words Preforeclosure or Pre-Foreclosure sales are sometimes used in place of a short sale.&nbsp;&nbsp;</p>
<p>The cause for a short sale can be due to a variety of reasons. Property owners (Mortgagors) may be in default on their mortgage due to employment issues, divorce, medical challenges, death, unexpected debt and other hardships. Some may have bought at the top of the real estate market and now find themselves &ldquo;upside down&rdquo; on their mortgage. Others may have drained equity out of their property through refinancing. In any case, they find themselves unable to make their payments and faced potential foreclosure.&nbsp;</p>
<p>One of the key requirements in buying a short sale is having patience. Many potential home buyers find that short sale listings take forever and never close. Many Real Estate Agents, experienced in listing or assisting in the buying of short sales, question whether it&rsquo;s really worth the time. That may change.</p>
<p>Recently, there was a great article in the January 31, 2010, AJC homefinder section of The Atlanta Journal-Constitution (AJC) by John Adams, &ldquo;<a href="http://www.ajchomefinder.com/mortgage-center/big-news-on-short-286575.html"><span style="color: #0000ff;">Big News on Short Sales</span></a>&rdquo;. John talks about a new rule that is going into effect in April that will force many of the big lenders to respond to short sales within 10 business days of getting an offer. This new rule will solve one of the biggest challenges that face buyers wanting to buy a short sale. Today, many buyers wait weeks and months to hear back whether a loan servicer (lender) has accepted or countered their offer. It also affects the property owner which in many cases face foreclosure before the deal is accepted.</p>

<p>So, expect to see big changes in the amount of interest in buying short sales this year. At a recent seminar by the <a href="http://www.okelleyandsorohan.com/"><span style="color: #0000ff;">Law Firm of O&rsquo;Kelley &amp; Sorohan</span></a>, Joe O&rsquo;Kelley Jr stated that we can expect the distressed property challenge to continue for at least another two years. Currently, close to 50% of homes sold are distressed. That&rsquo;s bad news for many home owners, but great news for home buyers and investors.</p>

Now if we can get the weather to warm a little, things would be really great. As you know, the lake level has come up with all the rain we&rsquo;ve been getting. Plus, with the Stock Market and Consumer Confidence growing it&rsquo;s just a matter of time before lake property and second homes become a priority again. I&rsquo;m averaging about four showings a week with potential lake property buyers that want to take advantage of the &ldquo;great deals&rdquo;.</p>
<p><strong>Lake Hartwell Home sales improved 15% over 2008</strong>. That&rsquo;s a strong indicator that we&rsquo;re moving in the right direction. Average Sale prices have decreased by 22% with most buyers looking in the $200,000 to $350,000 range.</p>
<p>Unfortunately, lake lots have not had the success that homes have had. Lenders have not been willing to open up the way that they used to for lot purchases. Plus, buyers that may have wanted to build, are now finding that they can buy a resale much cheaper then spending the money to build. Many lake lot owners wanting to sell are willing to take big losses just to move their property.</p>

Wow, what a difference a year makes! All it took was a lot of prayer, near record rainfalls, and today we&rsquo;re at full pool. Lake home owners are optimistic again, and there&rsquo;s an increase in Real Estate activity for Lakefront property. &nbsp;</p>
<p>Here's some great news! 2009 sales of Waterfront Lake Homes saw an increase of 12% over 2008 sales. That&rsquo;s not much, but it signals things are improving. Plus, buyers are getting great bargains. Last year the average sale price was approximately 88% of the original list price. This year that figure has dropped to 80%. &nbsp;Every lake home buyer that I talk to wants the same thing &ndash; &ldquo;<strong>a great deal</strong>&rdquo;.&nbsp; As 2010 begins and the inventory improves, indicators show that buyers will get what they want.&nbsp;</p>
<p>Here are statistics for 2009 <strong>&ldquo;waterfront&rdquo; </strong><a href="http://www.lakeandhomesearch.com/"><span style="color: #0000ff;"><strong>Lake Lanier Real Estate</strong></span></a>. <p>&nbsp;For example, three weeks ago I was asked by a lake lot owner (and seller) to do a comparative market analysis on this property and let him know if his taxes were similar to others that were on the market for the same price. Two years ago his lake lot was on the market for close to $260,000. Today, his lot is listed for less then $150,000 and still hasn&rsquo;t sold. Here are two paragraphs from a letter that accompanied the analysis:</p>
<p><span style="color: #3366ff;">1.&nbsp; When comparing this subdivision to others in the same price range, it appears taxes, appraisals and assessments are totally out of line. For example, your total tax appraisal (according to the CRS Property Report, through the MLS) is shown at $151,530. After pulling other similar &ldquo;Active&rdquo; listings in the same price range ($145-150k) the average total tax appraisal was approximately $108k. That&rsquo;s a pretty significant difference, (and those are probably high for the existing housing market and economy).</span></p>
<p><span style="color: #3366ff;">2.&nbsp; Values have clearly declined as seen in the last 11 months of Sales and Listing activity. As of today&rsquo;s date, November 22, 2009, according to the SC Western Upstate MLS, only 9 lake lots have sold, out of 254 &ldquo;Active&rdquo; listings. When you compare the sale price to the list price, lots sold for just 62% of the &ldquo;original&rdquo; list price (this doesn&rsquo;t reflect list prices, which could have been even higher, on earlier listings of those properties).&nbsp;&nbsp; </span></p>
<p>This property owner was told by the Assessors office that if they went out and reassessed his lot it could come back even higher. It appears that this scare tactic is being used quite frequently. In his case, it&rsquo;s not going to work &hellip;he&rsquo;s determined to have his day in court.</p>
<p>I urge you to look up some old issues ( December 7 &ndash; 11, 2009) of the Atlanta Journal Constitution (AJC). During this week the AJC ran a weeklong series on the <a href="http://www.ajc.com/news/why-youre-paying-too-228962.html"><span style="color: #0000ff;">&ldquo;Property Tax Meltdown&rdquo;.</span></a> After each article they concluded with, <a href="http://www.ajc.com/news/lowering-your-atlanta-property-229062.html"><span style="color: #0000ff;">&ldquo;What you can do now &ndash; How to lower your tax bill &ndash; Returns and Appeals 101&rdquo;.</span></a> Following many of their tips could save you thousands of dollars.</p>

It wasn&rsquo;t too long after that blog, that the office became a reality. <a href="http://www.kwgreenvillesc.com/"><span style="color: #0000ff;">Tommy Stevenson, Operating Principle (OP),</span></a> for the Market Center has hired Jan Rogers as Team Leader. </span></p>

Currently, they have 73 Agents working out of the Market Center (Anderson and Powdersville). Not bad for an office just a couple months old.</span></p>

Here is an excerpt from that letter:</span></p>

If you have a permit that was issued over one year ago and have not installed your dock, this is a very important notice for you. The deadline for dock installation is <strong style="mso-bidi-font-weight: normal;">January 1, 2010</strong>. </span></span></p>

We continue to urge those who have adequate water depth to install their dock to avoid a back-log of dock installations at the end of the year. As you may know, Lake Hartwell has over 962 miles of shoreline, and about 70% of that is in South Carolina.<span style="mso-spacerun: yes;">&nbsp; </span>So&hellip;which one serves Buyers and Sellers the best?</span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: Times New Roman;">&nbsp;</span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: Times New Roman;">It depends on who you talk to. Brokers that work out of Georgia (GA), and prioritize the GA side of the lake, would say GAMLS is the best. Brokers in South Carolina (SC) would say the SC Western Upstate MLS is a better choice because the majority of the lake is in SC. Fortunately; many Lake Hartwell Agents have access to both MLS systems and are licensed in both States. Based on my research and experience, the SC Western Upstate MLS has the most Lake Hartwell listings and is more &ldquo;user friendly&rdquo; than GAMLS. Recently I tested this assumption by sending the same property from each MLS system to a customer in Georgia. They were far more impressed by the SC Western Upstate MLS than the GAMLS system. </span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: Times New Roman;">&nbsp;</span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: Times New Roman;">Personally, I use both MLS systems to market and give access to my Sellers and potential Buyers. Unfortunately, many Brokers don&rsquo;t list all of their lake listings in both systems so Buyers on <a href="http://www.sayjaylakeandhome.com/WHAT-IS-NEW-LISTING-AUTO-NOTIFICATION">Auto Notification</a> may not see all of the available properties in their search criteria. Sellers don&rsquo;t get the exposure that they&rsquo;re expecting.</span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: Times New Roman;">&nbsp;</span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: Times New Roman;">So, if you&rsquo;re a potential Buyer, what should you expect from your Buyer&rsquo;s Agent? I would ask to have access to both MLS systems so I would have more options and choices. I would want to get new <a href="http://www.lakeandhomesearch.com/"><span style="color: #0000ff;">listings from SC Western Upstate MLS Auto-Notification</span></a>, and also I would want <span style="color: #0000ff;"><a href="http://www.georgiamls.com/agentsite/search/mainsearch.cfm?SiteID=HUFNAGELJAY"><span style="color: #0000ff;">access to GAMLS </span></a></span>to be sure I saw all of the listings on the GA side of Lake Hartwell that may not have been entered into the SC system.<span style="mso-spacerun: yes;">&nbsp; </span>As a Seller, I would make sure my property was listed in both MLS systems to get the most exposure.</span></p>

Isn&rsquo;t it common sense that, if water runs through your property, you should be able to use it for appropriate purposes? I can&rsquo;t believe all the hoopla over the use of <a href="http://en.wikipedia.org/wiki/Lake_Lanier"><span style="color: #0000ff;">Lake Lanier&rsquo;s</span></a><span style="color: #0000ff;"> </span>water. Even before the lake was built in 1956 water from the <a href="http://en.wikipedia.org/wiki/Chattahoochee_River"><span style="color: #0000ff;">Chattahoochee</span></a><span style="color: #0000ff;"> </span>and <a href="http://en.wikipedia.org/wiki/Chestatee_River"><span style="color: #0000ff;">Chestatee</span></a> rivers was used by the people that inhabited the area around the river banks. It&rsquo;s hard to imagine that Congress, when they originally set up the purposes for the lake, would want to exclude all of the municipalities that surround the lake, from using its water.<span style="mso-spacerun: yes;">&nbsp; </span><a href="http://www.1071coalition.org/downloads/Gainesville%20Times%20Water%20OpEd.pdf"><span style="color: #0000ff;">A recent article from the Gainesville Times (July 30, 2009)</span></a><span style="color: #0000ff;"> </span>ran an opinion column by Lt. Governor Casey Cagle (recently sent out by the <a href="http://www.1071coalition.org/home.asp"><span style="color: #0000ff;">1071 Coalition</span></a><span style="color: #0000ff;"> </span>Group to their membership). In the article, Cagle said &ldquo;Georgia has a fundamental right to the water that originates from its rivers and rain.&rdquo;</span></p>

One critical goal of the 660 Coalition is to facilitate the scientific research needed to develop an updated plan that will provide elected officials with the information they need in order to change the almost 50 year-old Corps plan.</span></span></span></span></p>
